Terms of Service

1. Agreement and acceptance
These Terms of Service govern your use of Progressly. By creating an account, accessing, or using the service, you agree to be bound by these terms.
2. Eligibility and account registration
You must be legally able to enter into a binding agreement in your jurisdiction. You agree to provide accurate account information and keep it up to date.
You are responsible for maintaining account security and for all activity under your account. You must promptly notify us if you suspect unauthorized access.
3. Service scope
Progressly provides coaching workflow tools, including client tracking, habits, check-ins, reporting, and related operational features. We may improve, modify, or discontinue features over time.
4. Subscription, billing, and taxes
Paid plans are billed on a recurring basis through our payment provider. Plan limits and entitlements are enforced according to your active subscription.
You authorize recurring charges until cancellation. You are responsible for applicable taxes, duties, and fees unless required otherwise by law.
5. Refund policy
All purchases are final and non-refundable, except where a refund is required by applicable law.
If a full refund or chargeback is processed by our payment provider, paid entitlements are removed immediately and the account is moved to the Free plan.
6. Cancellation, failed payments, and entitlement rules
You can cancel anytime. When you cancel, your plan remains active until the end of the current billing period unless otherwise stated.
- Cancellation: period-end access by default (no immediate mid-cycle downgrade unless required by law or abuse/security enforcement).
- Failed renewal payment (`past_due` or `unpaid`): paid entitlement grace period applies for up to 7 days after period end. After grace expires, account is downgraded to Free until payment recovery.
- Full refund or chargeback: immediate downgrade to Free.
7. Acceptable use
You must not misuse the service, disrupt platform operations, attempt unauthorized access, or upload unlawful or harmful content.
8. Client data and permissions
Coaches are responsible for obtaining all required permissions and legal bases to store and process client information in Progressly. You represent that data you submit can be processed for the intended coaching purpose.
9. AI-generated insights disclaimer
AI outputs are provided for informational and productivity purposes only. They may contain inaccuracies and should be reviewed by a human before use.
Progressly does not provide medical, mental health, legal, or financial advice. You are solely responsible for decisions made using platform outputs.
10. Intellectual property
Progressly and its original software, content, and branding are owned by Progressly and protected by applicable intellectual property laws. Except for limited use rights granted by your subscription, no rights are transferred to you.
11. Third-party services
We rely on third-party infrastructure and providers (for example, authentication, data hosting, payments, email delivery, and AI). Their outages, delays, or policy changes may affect service availability.
12. Service availability
We aim for reliable uptime, but service may be interrupted for maintenance, upgrades, or unexpected outages.
13. Warranty disclaimer
The service is provided on an "as is" and "as available" basis to the maximum extent permitted by law, without warranties of any kind, express or implied.
14. Limitation of liability
To the maximum extent permitted by law, Progressly is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the service.
15. Termination
We may suspend or terminate access if these terms are violated, if required by law, or if use presents security or legal risk. You may stop using the service at any time.
16. Changes to these terms
We may update these terms from time to time. Material updates will be reflected by an updated "Last updated" date. Continued use after changes means you accept the revised terms.
17. Governing law
These terms are governed by applicable laws of the jurisdiction where Progressly operates, unless mandatory local consumer law requires otherwise.
